Runetale Terms of Service

1. Application of the Terms

The Runetale Terms of Service (hereinafter referred to as "these Terms") define the conditions for using the P2P full-mesh VPN service "Runetale" (hereinafter referred to as "the Service") provided by Runetale Inc. (hereinafter referred to as "the Company"). These Terms apply to individuals (hereinafter referred to as "Users") who use the Service.

  • If an Admin User (defined in the following article) uses the Service on behalf of a corporation, organization, or similar entity, these Terms also apply to that entity. In such cases, the actions of the Admin User are deemed to be the actions of the entity.

  • In cases of conflict between these Terms and any other terms, rules, or policies separately defined by the Company for the Service (collectively referred to as "the Terms, etc."), these Terms shall take precedence.

2. Content of the Service

The Service enables encrypted communication between devices via a P2P full-mesh VPN. Unlike traditional VPN services where the service provider (VPN Gateway) intermediates communication, the Service allows direct communication between devices without intermediaries. Therefore, the Company cannot access the content of communications between Users.

  • All Users logged in under the same domain (the portion of the account name after "@") belong to the same network (e.g., aaa@XYZ.com and bbb@XYZ.com belong to the same network). Users can register devices to their network, and communication via the Service is limited to devices registered in the same network. Device information (e.g., device name, IP address) becomes visible to other Users within the same network upon registration.

  • The first User to log in to the Service within a network automatically becomes the network administrator (hereinafter referred to as "Admin User"). The Admin User can manage the Service usage of other Users in the same network, such as setting permissions and viewing registered devices. Admin Users can also delegate administrative rights to others. Since communication occurs directly between Users' devices, Admin Users cannot access the content of communications between Users.

3. Usage License

Users may use the Service in accordance with these Terms, etc. The specific content of the Service available to each User depends on the Admin User's selected plan and settings. Some portions of the Service are licensed under the Company's open-source license as specified in the Runetale Solution. Users are subject to the terms of such licenses for open-source components.

4. Conditions for Using the Service

To use the Service, Users must log in using an SSO (Single Sign-On) service integrated with the Service, such as Google Workspace or Azure Active Directory (hereinafter referred to as "Linked SSO Service").

  • Users must download the application software provided by the Company via app stores (e.g., App Store, Google Play). The app is available for free. Users acknowledge that these Terms apply only between the User and the Company, and not between the User and Apple or Google, who bear no responsibility for the Service.

  • Users are responsible for preparing the necessary devices and environment (e.g., smartphones, communication devices, operating systems, power) at their own expense and responsibility.

  • Any communication costs incurred while using the Service are the User's responsibility.

  • When using services provided by third parties (e.g., Linked SSO Services) via the Service, Users must comply with the terms of use and other regulations defined by the third parties.

5. Intellectual Property Rights

All copyrights and other intellectual property rights (collectively referred to as "Intellectual Property Rights") related to the Service belong to the Company or third parties who grant the Company such rights. These Terms do not transfer or grant any Intellectual Property Rights to the User.

6. Prohibited Actions

Users must not engage in the following actions when using the Service:

  1. Violating laws, regulations, or these Terms, or actions that may lead to such violations.
  2. Actions against public order and morality.
  3. Illegal or improper access, acquisition, alteration, disclosure of other Users' accounts, personal information, or data.
  4. Exploiting bugs or malfunctions of the Service.
  5. Sharing Linked SSO Service credentials with third parties.
  6. Registering unauthorized devices to the Service.
  7. Reverse engineering, decompiling, disassembling, or any action aimed at acquiring the Service's source code.
  8. Any other inappropriate actions as reasonably determined by the Company.

7. Handling of Personal Information

The Company will handle Users' personal information appropriately in accordance with its Privacy Policy.

8. Suspension of Service Use

The Company may restrict or suspend a User’s use of the Service without prior notice if the User:

  1. Violates these Terms or has violated them in the past.
  2. Is determined to have connections with antisocial forces.
  3. Is otherwise deemed inappropriate as a User based on reasonable grounds.

9. Temporary Suspension of the Service

  1. The Company may temporarily suspend the Service for periodic maintenance or upgrades with prior notice.
  2. In urgent cases (e.g., interference by third parties), the Company may suspend the Service without prior notice.

10. Discontinuation of the Service

  1. The Company may discontinue all or part of the Service at its discretion.
  2. Users will be notified in advance if the Service is discontinued.

11. No Warranty

The Company provides no warranties for the Service, including its suitability, performance, or security. Users may experience delays or interruptions.

12. User Responsibility

Users are liable for damages caused to the Company or others in connection with the use of the Service.

13. Limitation of Liability

The Company’s liability is limited to direct and ordinary damages caused by its gross negligence.

14. Notices

The Company will notify Users through the Service, email, or other appropriate methods.

15. Confidentiality

Users must not disclose confidential information shared by the Company without prior written consent.

16. Amendments to These Terms

The Company may amend these Terms without prior consent if the changes are reasonable or beneficial to Users. Notices of amendments will be provided appropriately.

17. Severability

If any provision of these Terms is deemed invalid, the remaining provisions remain enforceable.

18. Governing Law

These Terms are governed by Japanese law. The Tokyo District Court has exclusive jurisdiction over disputes.
